Occupy Austin – Capitol Police Clarify NEW Memo Confirming 24/7 Access to the Capitol Grounds

MEMO Released by DPS on 12/1/11:

Anyone may visit the Capitol at any time to exercise his or her rights guaranteed by the United States Constitution and the Texas Constitution. Visitors may remain in the Capitol building during operating hours. The Capitol grounds are open 24 hours a day.

To balance the needs of all Texans who wish to visit their State Capitol, as well as ensure the safety of visitors, the State Preservation Board adopted rules regulating the conduct of any person who visits the Capitol. These rules were adopted in 1994 and amended in 2000. They can be found in the Texas Administrative Code at section 111.27. The State Preservation Board enforces these rules regardless of the stated purpose of the individual violating the rules. These rules are in addition to any other generally applicable laws.

Many groups follow the State Preservation Board procedures for scheduling an event and reserving a location on the grounds or inside the building. These groups will receive priority over visitors who have not scheduled an event. Visitors will be asked to relocate to a different area of the building or grounds if necessary to accommodate a scheduled event.

The State Preservation Board is responsible for preserving, restoring, and maintaining the Texas State Capitol for the benefit of all Texans. Ensuring that the building and grounds are safe and accessible for all visitors is a priority. The restrictions that are in place are necessary to maintain this historic building and its grounds for the enjoyment of all visitors.

There seems to be some confusion. Students rioted at Penn State. And some have picked the wrong side. They protested the firing of legendary coach, Joe Paterno. Not the loss of the innocence of children.

Did I miss something? A respected adult has KNOWLEDGE about young boys being molested and does next-to-nothing to stop it. Now, years later, there are finally consequences. Someone is finally standing up for the victims, who…again, were CHILDREN…. and people are protesting?

Ahhh…. but relief… some students, like these here, DO get it and instead of wanting to yell, “where are your parents??” I find myself wanting to send their parents a note of congratulations — as these are the young adults I hope my children will emulate.

HOUSTON (CBS Houston) – The child sex abuse scandal coming out of Penn State University involves alleged child sex crimes, one of which may have occurred in Texas when the school’s football team was in San Antonio for the Alamo Bowl in 1999.

San Antonio police Sgt. Chris Benavides told the Associated Press Thursday that his department is “looking into the possibility that an offense may have happened” while the football team was in town.

Former Penn State coach Jerry Sandusky, who coached at Penn State for more than 30 years, is the accused perpetrator and faces child sex abuse charges in Pennsylvania. A grand jury report says a young boy, who was allegedly molested, was threatened to be sent home if the victim resisted Sandusky’s criminal sex acts against him.

Legendary coach Joe Paterno was fired Wednesday for his role in not reporting to police what he knew about Sandusky’s alleged crime.

Texas: Red Light Camera Tickets a Man Running a Green Light
Port Lavaca, Texas issues $75 ticket to man who ran a green light.

Green light ticketCities that use automated ticketing machines at intersections routinely assert two things: The camera does not lie, and at least three humans review each citation before it is dropped in the mail. That did not happen in Port Lavaca, Texas. On September 12, Port Lavaca Police Sergeant Kelly Flood signed a ticket accusing Dale Price of running a red light and demanding he pay $75 by October 12, but the light was green.

“Based upon my review and inspection of the recorded images, I state that a violation of ordinance #S-1-08 did occur,” the ticket stated just above Flood’s signature. “I declare under penalty of perjury under the laws of the state of Texas the foregoing is true and correct.”

On September 6 at 12:04pm, Price drove his grey 2009 GMC pickup through the intersection of US 35 and Travis Street. He was making a left-hand turn, with turn signal active, at 17 MPH. According to the red light camera, the light had been red for more than a minute. According to the photographs (view first photo, view second photo), and the video evidence, the light remained green throughout his turn. After being notified of the citation, local officials scrambled to order Redflex Traffic Systems, the Australian company in charge of the program, to cancel the ticket (view ticket). That is not good enough for Port Lavaca Citizens Against Red Light Cameras, a group working on a petition that would allow voters to decide the camera program’s future.

“This is one of the reasons that we’d want to shut down the program,” group co-founder Dwayne Buehring told The Newspaper. “We don’t know how many people have paid tickets without looking at the video. Because of the scare tactics they use, some people are just going to pay. This cop down there is just mailing them out to everyone.”

The group is looking to collect the 200 signatures needed to place a ban on red light cameras before voters. Earlier this year, the group succeeded in gathering those signatures, but the city cited the court case in Houston as a reason not to place the measure on the ballot. With a new petition, activists are say the law is now firmly on their side. They cite the very ruling of federal Judge Lynn Hughes that attempted to save Houston’s red light cameras as a reason why the Port Lavaca vote must proceed (view ruling).

“Clearly the city was in error when they rejected placing our petition on the ballot,” Carl Baugh and Dwayne Buehring wrote in a June 20 letter to the city council. “The case you were waiting on for vindication of denying a vote has not gone your way. While the judge did rule that Houston was in error for placing the issue on the ballot it was merely because it was untimely as Houston has a thirty-day limit on referendums. The Port Lavaca charter has no such restriction. By your own statements as well as your ministerial duty to the citizens of Port Lavaca you have an obligation to immediately proceed with the process to place our petition on the next legal election.”

Buehring, who recently moved to Houston, is still helping to collect signatures.

“We know the 500 people who signed it last time, we just have to go see them,” he said.

As the resurrected TSA anti-groping bill cleared the House Committee on Criminal Jurisprudence, and gathered enough support to pass both chambers, Texas state officials have recounted disturbing stories that highlight how the TSA is using forceful pat-downs as a form of “punishment” to those who opt out of the full body scanners.

“Let me put this delicately. I was still feeling the effects of the pat-down as I sat in my seat from New Orleans to Houston, and then Houston to Austin.” Chairman of the Texas Public Utilities Commission Barry Smitherman told Fox 7 News.

Smitherman described the groping as “aggressive” and recounted an admission by a TSA supervisor that he was being “punished” for opting out.

Texas State Rep. Barbara Nash also told Fox 7 that a TSA agent “moved my legs apart and went up my legs, all the way up, and then she made me stand a different way where she could go all the way up the front., and then all the way up the back of my dress.”

State Rep. David Simpson, who sponsored the original anti-groping bill, House bill 1937, noted “This is a sexual assault in any other activity. If that happened right now, it would be sexual assault.”

HB 1937, the regular session bill banning TSA groping, cleared the House floor but was not taken up in the Senate following threats to effectively implement a no fly zone over the entirety of Texas by TSA officials and a federal judge.

However, the bill was was refiled in the special session: Senate Bill 29, authored by Senator Dan Patrick, and House Bill 41 authored by Rep. David Simpson, as well as 112 co-sponsors (out of 150 Reps.) .

HB 41 was cleared Unanimously by the House Criminal Jurisprudence Committee and the dignity of Texas travelers, including women and children, is now in the hands of Governor Rick Perry, who must call for the bill to be addressed on the House floor.

Senator Patrick declared this week that he has gathered enough support, 18 out of 31 Senators, to successfully pass HB 41. In a letter to Perry, Patrick urged the Governor to consider the bill.

“I have polled the members of the Senate on Senate Bill 29 [the Senate's companion to HB 41] in an effort to bring the TSA anti-groping bill back to the floor,” Patrick wrote.
